Wife of man killed by cop gets RM90,000
KUALA LUMPUR, June 16 — A housewife, whose husband died after being beaten by a police constable eight years ago, will receive RM90,000 in damages for his death from the police and the government.
Lawyer M. Manoharan, who represented Siti Rohana Mohamed, 27, said the amount was reached in an out of court settlement in the RM2 million negligence suit filed by her client against the government and five others.
He said the government and four defendants in the suit — head of Puchong police station, Petaling Jaya district police chief, Selangor police chief and Inspector-General of Police — agreed to an out of court settlement.
The government agreed to pay the amount without being held responsible for the incident, he told reporters here today.
Meanwhile, the case management against Constable Mohd Izwan Sahak, 28, who was named the first defendant in the suit, had been postponed to a date yet to be fixed.
In her suit filed on June 19, 2003, Siti Rohana sought a declaration that the defendants had contravened Article 5 of the Federal Constitution and a declaration that they had failed to abide by Section 20,21 and 24 of the Police Act 1967.
She had sought RM2,020,652.00 in special, aggravated and/or exemplary damages.
In her statement of claim, Siti Rohana said that about 1pm on May 26, 2002, while her husband, Ramli Othman, was riding a motorcycle with Mohamed Fadelli riding pillion, Mohd Izwan, had, without warning, swung a piece of wood at him and it hit him on the head.
Siti Rohana claimed that Mohd Izwan's action, which resulted in Ramli's death, was vicious, reckless, malicious and with intention to kill.
She claimed that as a result of Mohd Izwan's action, her husband had to endure pain and sufferings until his death on May 29, 2002.
She also claimed that Mohd Izwan failed to give warning or used other alternatives to detain her husband and that he also failed to provide emergency aid to save her husband, despite pleas by her brother-in-law, Rahmad Othman.
On Oct 15, 2009, the High Court sentenced Mohd Izwan to 10 years' jail when he was found guilty of causing Ramli's death. — Bernama
